Note: Our services are informational and advisory in nature. We do not guarantee admission to any educational institution or approval of any visa application.

3. User Eligibility and Account Registration

3.1 Eligibility

You must be at least 13 years of age to use our Platform. If you are under 18, you must have parental or guardian consent. By using the Platform, you represent that you meet these requirements.

3.2 Account Registration

To access certain features, you must register for an account. You agree to:

Provide accurate, current, and complete registration information
Maintain and promptly update your account information
Keep your password confidential and not share it with others
Notify us immediately of any unauthorized use of your account
Take responsibility for all activities that occur under your account

4. Use of the Platform

4.1 Permitted Use

You may use our Platform solely for lawful purposes and in accordance with these Terms. Permitted uses include accessing consultancy services, submitting inquiries, and uploading documents required for your application.

4.2 Prohibited Conduct

You agree NOT to:

Use the Platform for any unlawful purpose or in violation of applicable laws
Impersonate any person or entity or misrepresent your affiliation
Submit false, misleading, or fraudulent documents or information
Attempt to gain unauthorized access to any part of the Platform or our systems
Upload viruses, malware, or any malicious code
Scrape, crawl, or extract data from the Platform without written permission
Interfere with or disrupt the integrity or performance of the Platform
Harass, abuse, or harm other users or our staff
Use the Platform for commercial solicitation without prior written consent

5. Fees, Payments, and Refunds

5.1 Service Fees

Certain services offered by Sabitri Edu may require payment. All fees are stated clearly before purchase. Prices are subject to change with prior notice.

5.2 Payment Processing

Payments are processed through secure third-party payment processors. By making a payment, you authorize us to charge your designated payment method. You are responsible for any applicable taxes.

5.3 Refund Policy

Refund requests must be submitted within 7 days of payment. Non-refundable fees include:

Application filing fees paid to third-party institutions
Government or embassy processing fees
Completed consultancy sessions or document reviews

Approved refunds will be processed within 10-15 business days.

6. Intellectual Property

All content on the Platform, including text, graphics, logos, images, icons, data compilations, software, and course materials, is the exclusive property of Sabitri Edu Consultancy or its licensors and is protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Platform solely for your personal, non-commercial educational consultancy purposes.

You may NOT reproduce, distribute, or publicly display our Content without prior written permission
You may NOT modify, create derivative works from, or reverse engineer any part of the Platform
You may NOT remove or alter any copyright, trademark, or proprietary notices

7. User-Submitted Content

By submitting documents, information, or other content to our Platform, you:

Represent that you are the rightful owner or have necessary permissions for the content
Grant us a non-exclusive, worldwide license to use, store, and process it to provide our services
Confirm the content is accurate and does not infringe any third-party rights
Acknowledge that submitting fraudulent documents may result in immediate termination and legal action

8. Disclaimer of Warranties

THE PLATFORM AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

The Platform will be uninterrupted, error-free, or secure
Any information provided will be accurate, complete, or up to date
Consultancy advice will result in university admission or visa approval
The Platform will meet your specific requirements

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SABITRI EDU CONSULTANCY AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND PARTNERS SHALL NOT BE LIABLE FOR:

Any indirect, incidental, special, consequential, or punitive damages
Loss of profits, data, goodwill, or other intangible losses
Rejection of university or visa applications
Unauthorized access to or alteration of your data
Damages arising from third-party services or linked websites

Note: Our total cumulative liability to you for any claims shall not exceed the amount you paid to us in the 12 months preceding the claim, or USD $100, whichever is greater.

10. Indemnification

You agree to indemnify, defend, and hold harmless Sabitri Edu Consultancy and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising from:

Your use of or inability to use the Platform
Your violation of these Terms
Your submission of false, inaccurate, or fraudulent information
Your infringement of any third-party intellectual property or other rights

11. Third-Party Services and Google Analytics

Our Platform integrates with third-party services including Google Analytics to improve user experience and measure platform performance. Use of these third-party services is subject to their respective terms and privacy policies. We are not responsible for the practices of third-party services.

Note: You acknowledge that Google Analytics may collect data about your use of our website as described in our Privacy Policy, and you consent to this data collection by continuing to use our Platform.

12. Termination

We reserve the right to suspend or terminate your account and access to the Platform at our sole discretion, without notice, for conduct that we believe:

Violates these Terms or our Privacy Policy
Is harmful to other users, us, or third parties
Involves fraudulent, deceptive, or illegal activity

Note: Upon termination, your right to use the Platform ceases immediately. Provisions that by their nature should survive termination shall survive, including Sections 6, 8, 9, 10, and 14.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or a prominent notice on the Platform at least 14 days before they become effective. Your continued use of the Platform after the effective date constitutes acceptance of the revised Terms.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Nepal (or the jurisdiction where Sabitri Edu Consultancy is incorporated), without regard to its conflict of law provisions.

Note: Any disputes arising from these Terms or use of our services shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration or the competent courts of the applicable jurisdiction.

15. Severability and Waiver

If any provision of these Terms is found to be unenforceable or invalid, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect. Our failure to enforce any right or provision shall not constitute a waiver of such right or provision.

16. Entire Agreement

These Terms, together with our Privacy Policy and any service-specific agreements, constitute the entire agreement between you and Sabitri Edu Consultancy regarding your use of the Platform and supersede all prior agreements and understandings.
